Pagrindiniai Sutarties Elementai

Buto nuomos sutartis yra esminis dokumentas, reglamentuojantis nuomotojo ir nuomininko teises bei pareigas. Šia sutartimi Nuomotojas perduoda Nuomininkui laikinai valdyti ir naudoti bendrojo ploto gyvenamąsias patalpas, o Nuomininkas įsipareigoja mokėti nuomos mokestį.

Nuomos Mokestis Ir Mokesčiai

Nuomininkas moka Nuomotojui mėnesinį nuomos mokestį. Taip pat, Nuomininkas kiekvieną mėnesį moka Nuomotojui nuomojamų patalpų komunalinių ir kitų paslaugų mokesčius.

Atsiskaitymo Tvarka

Pasibaigus šios sutarties terminui ar nutraukus ją prieš terminą, Nuomininkas sumoka visas Nuomotojui pagal šią sutartį mokėtinas sumas per 30 (trisdešimt) kalendorinių dienų nuo sutarties termino pasibaigimo ar sutarties nutraukimo dienos.

Sutarties Forma Ir Terminas

Supaprastinta arba standartinė buto nuomos sutartis gali būti terminuota arba neterminuota. Sudarant terminuotą sutartį, privaloma laikytis rašytinės formos, nepaisant, kas yra tokios sutarties šalys.

Rašytinė Forma

Rašytinė buto nuomos sutartis laikoma sudaryta, kai šalys ją pasirašo. Tačiau CK leidžia buto nuomos sutartį tarp fizinių asmenų sudaryti žodžiu.

Nuosavybės Teisės Pasikeitimas

Jei gyvenamosios patalpos nuosavybės teisė pereina iš nuomotojo kitam asmeniui, gyvenamosios patalpos nuomos sutartis lieka galioti naujam savininkui, jeigu gyvenamosios patalpos nuomos sutartis buvo įregistruota įstatymo nustatyta tvarka.
